The firm represents a significant number of media, internet and e-commerce enterprises, from television licensees and programs to bloggers and not-for-profit companies. We act as counsel for their commercial, copyright, TV programming formats and licensing matters, in addition to representing them in disputes with third parties. We advise them on “best practices” in areas relating to their websites, including ways to reduce their liability for user-generated content. We regularly advise on website development agreements and website hosting agreements. The nature of this work is international in scope, as internet sites are generally available worldwide. As such, we strive to keep our clients apprised of new developments in the ever-fluid legal environment – on matters such as privacy, protection of domain names from cybersquatters, spam, data protection, data mining, censorship, electronic licensing and cross-border taxation – with a view towards assuring the client’s continued compliance with relevant regulations.

Representative experience

  • Representing Jasmine TV Group in the sale of control in ‘July-August Communications and Productions Ltd’, the largest film and TV format developer in Israel, to the giant international content provider ProZieben of Germany.
  • Advising several television programs in monitoring content and selling TV formats worldwide.
  • Specialized terms of use, privacy policies and copyright policies for dozens of e-commerce, software, hardware and open platform companies.
  • Handling cybersquatting claims, including through WIPO arbitrations, for numerous companies, including Modu, Zend, and Seeking Alpha.
  • Content license and distribution agreements between Seeking Alpha and Yahoo!, e-Trade, and Reuters.
  • Co-branding agreements for Answers.com, Zap (leading Israeli price comparison site) and rest.co.il (leading Israeli restaurant site).
  • Internet advertising, placement and SEO (Search Engine Optimization) agreements with AdBrite, BURST! Media, Clicksor, SoapDom and Quinn Street.
  • Acquisition by Dapei Zahav of SEO company.
  • Represented an Israeli company in a strategic internet advertising and collaboration arrangement with Google, obtaining for the client significant cooperation benefits.
  • Representation of VOOM in licensing cable television programming.
  • Representation of Hug in litigation against a website which claimed that Hug had infringed its trade dress, content and other intellectual property rights. Successful in defeating preliminary injunction.
  • Represented popular user-generated content site in negotiating a favorable settlement for a copyright infringement dispute with EMI Music.
